Occupational Safety and Health Review Commission 

The Occupational Safety and Health Review Commission (OSHRC) handles administrative appeals from citations by the Occupational Safety and Health Administration (OSHA). It assigns cases to administrative law judges through the agency’s Settlement Part pilot program, E-Z Trial program and conventional hearing processes.  The Settlement Part was developed to minimize the need for proceeding to hearing on complex cases and as a vehicle to resolve high penalty disputes more quickly and economically, with mandatory settlement talks between the parties under the supervision of a settlement judge.  The E-Z Trial was implemented as an alternative to the traditional hearing process and is used for contesting federal occupational safety and health cases, with total proposed penalties of $20,000 or less, before the Review Commission judges.

The Indiana Conflict Resolution Institute planned, designed implemented evaluations of the Settlement Part and E-Z Trial programs.  The programs were evaluated for program effectiveness and program administration.  The evaluations will determine, among other things, whether:

the programs, as implemented, are consistent with their original design,

the programs are reaching the intended audience(s),

the programs achieve their goals and objectives (e.g., what is the impact of the programs on settlement rates, dispute resolution, and participant cost, time, and outcomes), and

participants’ satisfaction with the programs’ administration and outcomes (e.g., what are participants’ perception of procedural fairness, access to the programs, type of cases eligible for the programs, guidelines of the programs and benefits to and burdens on participants).
